Terms & Conditions
Our terms, in plain English
These terms apply whenever you order from Motion Foundry, whether that’s an animation from our Services page or a bespoke website, app or booking system. Please read them before you pay.
1. Who we are
Motion Foundry is run by Jasmine Johal, a sole trader trading as Motion Foundry.
Based in: Nottingham and London, United Kingdom
Email: hello@motionfoundry.co.uk
WhatsApp: +44 7917 652333
“We” and “us” means Motion Foundry. “You” means the person or business placing the order.
2. Consumers and business customers
Most of our customers are businesses. Some parts of these terms apply differently if you’re buying as a consumer (for yourself, not for a business). Where that’s the case, we say so. Nothing in these terms takes away your legal rights as a consumer.
3. Orders and quotes
- Services page orders (animations, graphics and packs): your order is accepted when your payment goes through and we email you a confirmation.
- Websites, apps and booking systems: we agree what’s included in a written quote first. The quote and these terms together make up our agreement. Quotes are valid for 30 days.
- Anything not in the quote or order, such as extra pages, features or deliverables, is extra work. We’ll always agree the price with you before starting it.
4. Payment
- Services page orders, booking systems and other work: paid in full upfront, before work starts.
- Websites and apps: a 50% deposit to start, and the remaining 50% when the work is finished, before it goes live or is handed over.
- Card payments are handled securely by Stripe. We never see or store your card details.
- Prices are shown in pounds sterling (GBP). If you view prices in another currency, that’s only a guide.
5. What we need from you
- To get started, we need your artwork, logo files, text, photos and any login details we need. Turnaround times start once we have both your payment and everything we need from you.
- If we’re waiting on you, your deadline moves back by the same amount of time.
- You confirm you own, or have permission to use, everything you send us (logos, photos, fonts, music, text), and that it doesn’t break anyone else’s rights.
6. Turnaround and delivery
- Same-day orders placed before 4pm UK time are delivered within 8 hours.
- Rush fees are charged per item ordered.
- Delivery times for websites, apps and booking systems are agreed in your quote.
- We’ll do our best to hit every deadline. If something outside our control causes a delay, such as illness or a third-party service going down, we’ll tell you straight away and agree a new date.
7. Revisions
- Every service includes 2 rounds of revisions, unless your package says otherwise (some packs include more).
- A revision is a change to the agreed design, such as colours, timing, wording or small layout changes. A new idea or a different brief is new work.
- Extra rounds on Services page orders cost £15 each. Extra rounds on bigger projects are quoted before we start them.
8. Cancelling and refunds
If you’re a consumer, you have the right to cancel within 14 days of placing your order. Because our work is made just for you, here’s how that works:
- If you cancel before we start, you get a full refund.
- If you ask us to start within the 14 days and then cancel, we refund what you’ve paid minus the cost of the work already done.
- Once the work is finished and delivered, you can no longer cancel.
If you’re a business customer, payments aren’t refundable once work has started. If you cancel a website or app part-way through, the deposit covers the work done up to that point.
To cancel, email hello@motionfoundry.co.uk. Refunds go back to the card you paid with, within 14 days.
If something we deliver is faulty or isn’t what we agreed, tell us and we’ll put it right free of charge. This doesn’t count as one of your revisions.
9. Who owns the work
- Once you’ve paid in full, the copyright in the final work we make for you passes to you. Until then, it stays with us.
- Fonts, stock images, music, plugins and other third-party items keep their own licences. We’ll tell you if any of these need a paid licence in your name.
- We may show the finished work on our website and social media as an example of what we do. If you’d rather we didn’t, just tell us.
10. Websites, apps and booking systems
- Running costs: you pay for your domain name, hosting, card fees on online payments, text messages and any other services your site or system uses. We’ll explain these before you start. They’re paid to those providers, not to us, and can change.
- Your site or system relies on outside services, such as hosting providers, Stripe and email providers. We aren’t responsible for their outages, price changes or changes to how they work.
- You’re responsible for what goes on your site after handover, including your own prices, policies and privacy notice. You’re also responsible for how you use your customers’ information.
- If anything we built doesn’t work as agreed, tell us within 30 days of going live and we’ll fix it free. Changes and new features after that are quoted separately.
11. Our responsibility to you
- We’ll carry out our work with reasonable care and skill.
- We aren’t limiting our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit.
- For business customers: we aren’t responsible for loss of profit, sales, business or data. Our total liability is limited to the amount you paid us for that order or project.
- For consumers: we’re responsible for loss or damage you suffer that was a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
12. Complaints
If you’re unhappy with anything, please email hello@motionfoundry.co.uk. We’ll reply within 2 working days and do our best to sort it out.
13. The law that applies
These terms are governed by the law of England and Wales, and any disputes go to the courts of England and Wales. If you’re a consumer living in Scotland or Northern Ireland, you can also bring a claim in your local courts.
14. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one shown here when you paid or accepted your quote.
